PokketCoach Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PokketCoach application, websites, and related services (collectively, the “Services”) provided by PokketCoach, Inc. (“PokketCoach,” “we,” “us,” or “our”). By using any part of the Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Description of Services
The Services help users explore sports-psychology and mental-performance concepts through educational content, psychometric assessments, progress-tracking tools, and an AI assistant (“Pokket”). The Services are for informational purposes only and are not a substitute for professional care.
2. Important Disclaimers
- No medical or mental-health services.
- No therapist-client relationship.
- AI limitations. Responses may be inaccurate, biased, or inappropriate.
- Not for emergencies. In crisis, call local emergency services.
3. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you confirm you have parental consent.
4. User Accounts
Registration. Provide accurate information and keep it current.
Security. You are responsible for activities under your credentials. Report unauthorised use to privacy@pokketcoach.com.
5. Payment Terms
5.1 Plans & Pricing
- Monthly Plan: US $40 per user, billed every month.
- Weekly Plan: US $10 per user, billed every week.
5.2 Billing & Auto-Renewal
Each plan is billed in advance and automatically renews until you cancel. By subscribing, you authorise recurring charges to your chosen payment method.
5.3 Plan Changes & Proration
You may switch between plans at any time. If a change occurs mid-cycle, charges or credits will be prorated based on the remaining days of the current period.
5.4 Cancellation & Refunds
Cancel in-app or by email. Service continues until the end of the current billing period. Payments are non-refundable except where required by law.
5.5 Taxes & Price Changes
Prices exclude applicable taxes. We may modify pricing with at least 30 days’ notice by email or in-app alert. Promotional discounts or free trials may be offered at our discretion.
6. Licence to Use the Services
PokketCoach grants you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes, subject to these Terms and timely payment.
7. User Conduct
You agree not to:
- violate any law or regulation;
- harass, abuse, or harm another person;
- upload viruses or malicious code;
- reverse-engineer or scrape the Services;
- build a competing product using the Services;
- bypass security or content-filtering;
- use the Services as a substitute for professional care.
8. Intellectual Property
The Services and all content are owned by PokketCoach or its licensors. You retain ownership of your inputs (“User Data”) but grant PokketCoach a worldwide, perpetual licence to use that data to operate and improve the Services as described in the Privacy Policy.
9. Privacy
Our Privacy Policy explains how we collect and use your information. By using the Services you consent to those practices.

11. Disclaimers of Warranties
THE SERVICES ARE PROVIDED “AS IS.” POKKETCOACH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POKKETCOACH SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE SIX MONTHS BEFORE THE CLAIM AROSE OR (B) US $100.
13. Indemnification
You will indemnify PokketCoach for claims arising from your use of the Services, breach of these Terms, or violation of any law or third-party right.
14. Modifications to Terms
We may update these Terms at any time. Material changes will be announced in-app or via email. Continued use after changes constitutes acceptance.
15. Termination
We may suspend or terminate your access for any breach or non-payment. You may delete your account at any time by emailing us.
16. Governing Law & Dispute Resolution
Governing Law. Delaware law, excluding conflict-of-law rules, governs these Terms.
Mandatory Arbitration & Class-Action Waiver. Any dispute will be resolved by binding arbitration before a neutral arbitration provider under its applicable rules. You waive jury trials and class actions. Arbitration will occur in Delaware unless the parties agree otherwise. Either party may bring individual claims in small-claims court. You may opt out of arbitration within 30 days of first acceptance of these Terms by sending written notice to the address above.
17. General Provisions
- These Terms constitute the entire agreement between you and PokketCoach.
- If any provision is unenforceable, the remainder remains in effect.
- PokketCoach may assign these Terms; you may not without consent.
- All notices to PokketCoach must be sent to the address above.
