This Privacy Policy (“Policy”) explains how PokketCoach, Inc. (“PokketCoach,” “we,” “our,” or “us”) collects, uses, discloses, and safeguards information about you when you use any website, mobile application, or other online or offline service that links to this Policy (collectively, the “Services”). By accessing or using the Services, you agree to the practices described below. If you do not agree, please do not use the Services.

Service-nature notice. PokketCoach and its AI assistant (“Pokket”) are educational tools designed to help users explore sports-psychology concepts. They are not licensed psychologists or medical professionals and do not provide medical advice, diagnosis, or treatment.

No data sales or targeted ads. PokketCoach does not sell personal information to data brokers or advertising networks and does not display third-party interest-based advertising.

1. Information We Collect

We collect three broad categories of information. Some data is required to provide the Services; without it, certain features will not work.

1.1 Information you provide directly

Account data (required): first name, last name, email address, age (or date of birth).
Authentication data: credentials or tokens generated when you sign in with email/password or a third-party provider.
User content: chat messages with Pokket, journal entries, goals, psychometric-test answers and scores.
Referral data: information identifying who invited you (if you join via a referral link).
Payment data: limited billing details handled by an independent payment processor; we do not store full card numbers.
Support communications: any messages or attachments you send to us.

1.2 Information we collect automatically

When you use the Services we (and limited service providers acting on our behalf) automatically collect certain technical data, such as:

Device and browser information (type, model, OS version, language, screen size)
IP address and non-precise location (city/region)
Pages viewed, links clicked, timestamps, feature-use frequency
Identifiers (cookie IDs, mobile-device IDs) and Service version

This information is gathered via cookies, pixels, or similar technologies and is used solely for security, performance, and internal analytics.

1.3 Information from other sources

Data from third-party sign-in accounts you choose to link (in accordance with your permissions)
Public interactions with our social-media profiles (likes, comments, follows)
Referral information from other users

2. How We Use Information

Provide and administer Services
Personalise content
Communicate with you: transactional messages and, with consent, marketing emails
Analytics & improvement: maintain, enhance, secure, and train internal AI models
Fraud, security, and legal compliance
Develop new products or features
Any other purpose disclosed at collection or with your consent

We may combine data from different sources and may create aggregated or de-identified datasets that no longer identify you; we may use or disclose such datasets for any lawful purpose.

3. When We Disclose Information

We never sell personal information. We disclose it only in these limited circumstances:

Affiliates under common ownership that must follow this Policy
Vendors that operate payment processing, hosting, analytics, customer support, or similar functions under confidentiality
Legal or safety needs to comply with law or protect rights, property, or safety
Business transfers as part of a merger, acquisition, or asset sale
Your direction or consent (e.g., sharing a progress report you request)

4. Online Analytics

We employ first-party and limited third-party analytics tools to understand how users interact with the Services. These tools place cookies but do not use the data for cross-site behavioural advertising. You may disable cookies in your browser, though some features may be affected.

5. Tailored Advertising

PokketCoach does not engage in third-party interest-based advertising and does not disclose personal information to advertising networks.

6. Your Choices & Rights

Profile controls: update account details or deactivate your account at any time
Marketing opt-out: unsubscribe via any marketing email (transactional emails will still be sent)
Cookie controls: manage cookies through your browser or device settings
Region-specific rights: depending on your jurisdiction, request access, correction, deletion, restriction, or export of your data by emailing us (Section 14). You will not face discrimination for exercising a privacy right.

7. Regional Privacy Disclosures

7.1 European Economic Area & United Kingdom

PokketCoach, Inc. is the data controller. Processing bases include contractual necessity, legitimate interests balanced against your rights, your consent where required, and compliance with legal obligations. You may lodge a complaint with a supervisory authority, though we encourage you to contact us first.

7.2 Nevada Residents

We do not sell personal information as defined by Nevada law; therefore, no action is required to opt out.

7.3 California Residents (CCPA)

In the 12 months preceding this update we collected—and disclosed for legitimate business purposes—the categories of personal information listed in Section 1. We have not sold or shared personal information for cross-context behavioural advertising and do not knowingly sell or share the information of minors under 16.

CCPA rights include access, correction, deletion, and portability. Submit requests via the email in Section 14; identity verification is required. We do not use sensitive personal information for purposes subject to the right to limit.

8. Children’s Privacy

Not directed to children under 13. The Services are designed for users aged 13 and older. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use the Services.

If we learn that we have inadvertently collected personal information from a child under 13, we will delete it as required by law. Parents or guardians who believe we may have collected such information can email us at privacy@pokketcoach.com.

9. Security

We implement technical, administrative, and physical safeguards—including encryption in transit and at rest—designed to protect data from loss, misuse, and unauthorized access. No Internet transmission is perfectly secure, so we cannot guarantee absolute security.

10. Data Retention

We retain personal information for up to five (5) years after account inactivity or closure unless a longer period is required by law. Aggregated or de-identified data may be kept indefinitely for research and development.

11. International Transfers

The Services are operated in the United States, and your information will be processed and stored there. By using the Services, you consent to this transfer. Where required for EEA/UK users, we rely on appropriate contractual safeguards.

12. Links to Third-Party Websites

The Services may contain links to external sites we do not control. Their privacy practices are governed by their own policies, not this one. We encourage you to review those policies before providing information.

13. Changes to This Policy

We may update this Policy to reflect changes in law or our practices. We will revise the “Last Updated” date and, for material changes, provide additional notice (e.g., email or in-app alert). Continued use of the Services after an update constitutes acceptance of the revised Policy.
